Project Apex is a curated automotive marketplace operated from Belgium. The legal operator, enterprise and VAT identifiers, business address and professional contact details are published in the Legal Notice. These Terms govern use of the website, accounts, marketplace listings, Buyer Intent, Buyer Demand, dealer services, Founding Dealer pilots and paid Project Apex services.
By creating an account, submitting content, activating a pilot or purchasing a service, you agree to the version of these Terms presented to you at that time. Mandatory consumer and business-user rights that cannot lawfully be excluded remain unaffected.
Project Apex facilitates discovery, presentation and contact between buyers and sellers. Unless expressly stated otherwise, Project Apex is not the seller, buyer, broker, auctioneer, vehicle inspector, finance provider or party to the eventual vehicle transaction. Buyers and sellers contract directly with each other and remain responsible for their own legal, technical, financial and identity checks.
Only vehicles that fit the Project Apex curation framework may be published. Eligibility is based on model, variant, significance, character, presentation quality and the information available to Project Apex. Curation is editorial selection, not a mechanical inspection, valuation, authenticity certificate, warranty or guarantee of provenance, condition, legality, availability or future value.
Project Apex may approve, request changes, reject, expire or remove a listing where the vehicle does not meet the curation standard, the information is materially incomplete or inaccurate, the vehicle is no longer available, rights are disputed, fraud or illegality is suspected, or continued publication would create legal, security or marketplace-integrity risk.
Account information must be accurate and kept current. Dealer accounts require verification before commercial dealer functionality is enabled. Account credentials are personal to the authorised user and must be protected against unauthorised access.
Project Apex may restrict, suspend or terminate access for material breach of these Terms, fraud, misleading listings, infringement of third-party rights, abuse of buyers or sellers, circumvention of platform safeguards, payment failure, security risk, legal obligation or repeated conduct that materially harms marketplace integrity. Where rules applicable to business users require a statement of reasons or advance notice, Project Apex will provide it unless a lawful exception applies, including urgent security or legal action.
Sellers must have the authority to advertise the vehicle and must provide accurate, current and non-misleading information. Seller-supplied claims remain the seller's responsibility unless Project Apex expressly states that a specific fact has been independently verified. Sellers must promptly update or remove unavailable vehicles.
By submitting text, photographs and other listing material, the seller confirms that they own the relevant rights or have permission from the rights holder to publish the material on Project Apex. The seller grants Project Apex a non-exclusive, royalty-free licence for the duration reasonably necessary to display, resize, crop and format that material for the presentation and operation of the submitted listing. The seller retains ownership of its content. This listing licence is not a blanket or perpetual licence for unrelated Project Apex marketing.
Marketplace visibility is not sold through Dealer Partner. The default inventory order gives editorial Project Apex "Apex Selection" vehicles priority; within the remaining group the default is newest-first. A user may instead choose supported sorting such as price or mileage, and filters such as category, region, year, price or mileage can narrow the result set. Search and category context may also affect which vehicles a user sees.
Apex Selection is an editorial/admin decision. Legacy paid or credit-based featured records receive no public ranking boost. Paying €149 for Dealer Partner does not buy a higher ranking position and does not override vehicle eligibility or curation.
Eligible vehicles may be discovered through an approved external inventory relationship, direct dealer inventory or direct private submission. Display of externally discovered inventory does not create a free Dealer Partner account and does not imply that the dealer has endorsed Project Apex unless the dealer has explicitly participated. Source and dealer attribution are presented where available and lawful.
A selected Founding Dealer Pilot begins with an initial 90-day proof window at €0, up to five selected Project Apex-eligible vehicles, no sales commission, no exclusivity and no automatic paid conversion. The pilot starts only after explicit dealer approval. The 90-day point is a value-review point, not a payment deadline. If Project Apex considers that sufficient meaningful measurable value has not yet been demonstrated, Project Apex may offer an additional free validation period; such an extension is discretionary and is not an automatic or indefinite entitlement. Dealer Partner may be offered only after demonstrated value and still requires a separate explicit dealer choice. A continuation decision alone never activates payment.
Project Apex Dealer Partner is a recurring B2B service priced at €149 excluding VAT per dealership per month. It may include official Partner participation, management of current Project Apex-eligible stock, premium native presentation, Buyer Intent, Buyer Demand, matching and demand signals, consent-based introductions, dealer analytics and results measurement. There is no setup fee, no ordinary enquiry fee and no sales commission unless a separate written agreement expressly states otherwise.
Dealer Partner renews monthly until cancelled. Cancellation takes effect in accordance with the billing period shown in the account or billing portal. Payment does not guarantee traffic, buyers, enquiries, sales, revenue, return on investment or any specific ranking.
For Belgian B2B transactions within the statutory scope, activation is technically blocked until Project Apex and the dealer have verified billing identities and a compliant structured electronic invoicing route. Project Apex uses Peppol/Peppol-BIS as the standard route unless a lawful EN16931-compliant alternative has been expressly agreed where permitted.
During the Project Apex validation period, submitting and publishing an approved private vehicle is free. There is no listing fee and no sales commission. Publication remains subject to Project Apex curation and may be refused, changed or removed under these Terms. No future paid option is activated automatically; any later paid private-seller service must be communicated and accepted separately before a charge can arise.
The current validation-period private listing described above is free, so no consumer listing-payment or withdrawal workflow is triggered by that service. If Project Apex later offers a paid consumer service, the applicable price, pre-contract information, withdrawal rights and any request for immediate performance will be presented separately before payment.

Buyer Intent classifies information voluntarily submitted through an enquiry, such as requested next step or purchase timeline. It is not a verification of identity, funds, financing eligibility, seriousness or purchasing capacity. Buyer Demand is a structured search created or confirmed by a buyer. Buyer contact details remain private unless the buyer authorises sharing or an introduction in accordance with the product controls and Privacy Policy.
Participating dealers may access account data, their managed inventory, enquiries directed to them and analytics made available through the dealer product. Dealers do not receive unrelated buyers' personal data or another dealer's private commercial, billing or account data. Project Apex may retain legally required transaction, audit, security and compliance records after termination. Access to live dashboard functionality ends when the relevant entitlement ends, subject to mandatory law and any export functionality expressly provided before termination.
Material changes to terms governing an online intermediation relationship with professional users will be made available on a durable medium and, where Regulation (EU) 2019/1150 applies, with at least the legally required notice period, normally 15 days. A longer period will be used where reasonably necessary for technical or commercial adaptation. Statutory exceptions may apply for legal obligations, urgent cybersecurity matters or changes that cannot reasonably be subject to advance notice.
Users and business users may contact Project Apex at the professional contact address in the Legal Notice regarding account, moderation, technical or commercial issues. Project Apex will consider equivalent cases consistently and communicate material outcomes in plain language where required.
Anyone may notify Project Apex of specific hosted information considered illegal through the Report Content mechanism. A notice should identify the exact URL and provide a sufficiently substantiated legal reason. Project Apex may request further information and will assess notices diligently and objectively.
To the extent Project Apex qualifies as a small enterprise under applicable P2B rules, statutory exemptions for formal internal complaint systems and named mediators may apply. Project Apex nevertheless maintains the voluntary complaint channel described above.
Payments are processed through the payment provider shown at checkout. Project Apex does not store complete card details. Dealer pricing is stated excluding VAT; applicable VAT treatment depends on the parties and transaction. Consumer prices are presented as the total payable amount at checkout. Invoices and structured electronic invoices are issued as required by applicable law.
Project Apex does not guarantee the accuracy of seller-supplied information, vehicle condition, title, provenance, mileage, tax status, registration eligibility, market value, availability or the outcome of a transaction. Buyers must perform their own due diligence. Nothing in these Terms excludes liability that cannot lawfully be excluded, including mandatory consumer protections.
The Project Apex name, platform design, original editorial content, taxonomy, presentation systems and other Project Apex materials are protected by applicable intellectual-property law. No licence is granted except the limited right to use the platform for its intended purpose.
These Terms are governed by Belgian law, without depriving consumers of mandatory protections that apply under the law of their habitual residence where such protections cannot be waived. Competent courts are determined under applicable law; this clause does not remove any mandatory consumer forum.
